MANSFIELD, Circuit Judge:

In this action by Martin Erdmann, a New York attorney, against members of the Appellate Division, First Depart*1207ment, State of New York, seeking declaratory and injunctive relief against disciplinary proceedings instituted by them against him on the ground that the proceedings violate his constitutional rights, he appeals from denial of preliminary injunctive relief and dismissal of his complaint. Federal jurisdiction is invoked pursuant to Title 28 U.S.C. §§ 1343 and 2201, et seq., and the federal Civil Rights Act, Title 42 U.S.C. §§ 1983 and 1985. We affirm.
