This action arises from a dispute between two attorneys who represented the same client at different intervals. Plaintiff Michael Drezin, Esq. seeks payments from defendant Trina E. Delisser, Esq. of the legal fees which he had earned while representing their mutual client. Defendant Delisser now moves for a dismissal of the action, pursuant to CPLR 3211 (a) (7), on the ground that plaintiff Drezin has failed to state a cause of action.
