MEMORANDUM OPINION AND ORDER
GADOLA, District Judge.
Before the court is the defendants’ motion for summary judgment, pursuant to Federal Rule of Civil Procedure 56, filed on September 25, 1996. The defendants seek to dismiss, as a matter of law, plaintiffs claims for punitive and exemplary damages set forth in Counts XVI and XVII of the Amended Complaint, and plaintiffs claims for hedonic damages set forth in plaintiffs damage report.
