This was an action brought by C. H. Pratt against N. L. Ard, to recover the possession of the west half of the southeast quarter of section 2, township 26, range 20, in Allen county. The case was tried at the June term, 1889, by the court without a jury. The trial court found for the plaintiff; and the defendant brings the case here. A patent for the land was issued on the 3d day of November, 1873, to the Missouri, Kansas & Texas Railroad Company.
