HENDERSON, Judge.

Appellant was convicted of an aggravated assault, and his punishment fixed at a fine of $250 and thirty days confinement in the county jail; and prosecutes this appeal.

The facts show that appellant was the uncle of prosecutrix, a young married woman living with her husband some fifteen miles from the town of Hamilton. On the day of the alleged assault, appellant and prosecutrix rode to Hamilton in his wagon.
