This matter is before the Court on the motion of defendants, the Rhode Island Brotherhood of Correctional Officers (the “Brotherhood”) and Kenneth Rivard (“Ri-vard”), for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure on the four operative Counts contained in Plaintiffs Complaint. 1 Plaintiff, James T.
