Appeal from an order of the Supreme Court at Special Term (Crangle, J.), entered June 14, 1983 in Schenectady County, which, inter alia, denied defendant’s motion to dismiss the complaint. f Plaintiff, the former Mayor of the City of Schenectady, instituted this libel action based on an article that appeared in the August 20,1982 issue of the Schenectady Gazette, a newspaper published by defendant.
