This action for malicious prosecution was brought by appellant against appellee in the court below, the amount of damages claimed being $5,475.00. It was alleged in the petition that appellee, who is the chief of police of the city of Paducah, arrested ' appellant under a warrant issued at his instigation by the judge of the police court of the city of Henderson, charging her with the crime of grand larceny; that after appellant’s arrest she was taken by appellee to the city of Henderson, where she was guarded at her own expense until indicted,…
