1Opinion of the CourtWoodworth, J.
Henry Cunningham, the father of the respondent, died intestate in the year 1798, leaving three infant children, and a valuable estate in lands, consisting of two military lots containing 1,200 acres, and a farm in *363Orange county, containing about 40 acres. It appears that ^ere was no necessity for selling the lands, for the purpose of paying any debts, nor for the maintenance and e¿ucati0n of the infants.
