—In a proceeding pursuant to CPLR article 78, *715inter alia, to review a determination of the Commissioner of the Department of Finance, Town of North Hempstead, dated September 11, 1992, separating the petitioner from his employment in the position of Security Officer I in the Department of Parks and Recreation of the Town of North Hemp-stead, the appeal, as limited by the appellants’ brief, is from so much of a judgment of the Supreme Court, Nassau County (Roberto, J.), entered April 13, 1993, as annulled the determination and reinstated the petitioner with back pay.
