This matter comes before me on a motion by solicitor of defendant to strike out the bill of complaint on the ground that it discloses no cause of action and that complainant is not entitled to the relief prayed for.
The bill of complainant was filed on February 4th, 1936, to foreclose a mortgage dated July 26th, 1927, made by defendants, Frederick Moser and Agatha Moser, his wife, to Hermann Haase in the sum of $4,000, which mortgage was given to secure a bond made by the defendants to the said Hermann Haase bearing even date therewith and payable July 1st, 1932, with interest at five per…
