Reversing.

Jolmson Storms was employed by the appellant and defendant below, Pioneer Coal Company, to work in its coal mines in Bell county, Kentucky, and while so engaged he was accidentally injured in the course of his employment, from the effects of which death resulted. The appellee and plaintiff, A. J. Polly, qualified as his administrator and afterwards brought this action against defendant to recover damages for his decedent’s death.
