DICE, Judge.

The conviction is for driving while intoxicated; the punishment, 3 days in jail and a fine of $50.

The evidence was undisputed that on the day in question the appellant drove his 1956 Willys Jeep on U. S. Highway 82 in Grayson County. While so driving appellant was followed by two highway patrolmen after they observed him pass a truck on the highway without sufficient clearance.
