Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered June 25, 2009, convicting defendant upon his plea of guilty of the crime of attempted criminal possession of a controlled substance in the third degree.

Defendant was charged in a two-count indictment after a diaper containing cocaine was found in the trunk of his rental car during a traffic stop. Following a hearing, County Court denied defendant’s suppression motion insofar as it sought to suppress the cocaine.
