Tlie plaintiff (respondent) recovered a judgment for the full penalty of an indemnity bond and the defendant appealed.
*226Walter L. Meier, a bookkeeper in the employ of the plaintiff bank at New Madrid, Mo., was required in October, 1907, to give a bond to cover any defalcations or embezzlements. This bond was boug’ht of and signed by the defendant. In the application for the bond were certain questions asked the president of the bank which he as such answered in writing and signed, among which are the following:
