Steven Hazuri seeks review of the decision of the Third District Court of Appeal in Hazuri v. State, 23 So.3d 857 (Fla. 3d DCA 2009), on the ground that it expressly and directly conflicts with decisions of the Fourth and Fifth District Courts of Appeal in Barrow v. State, 27 So.3d 211 (Fla. 4th DCA), review granted, 49 So.3d 747 (Fla. 2010), Avila v. State, 781 So.2d 413 (Fla. 4th DCA 2001), and Roper v.
