INTRODUCTION
Now before this Court are the plaintiffs' motion for partial summary judgment and the defendants’ cross-motion for summary judgment, pursuant to Fed.R.Civ.P. 56. 1
Plaintiffs are the Board of Trustees of Local 41, International Brotherhood of Electrical Workers (“Local 41”), Health Fund (“Health Fund”), Board of Trustees of Local 41, Annuity Fund (“Annuity Fund”) and Board of Trustees of Local 41, Pension Fund (“Pension Fund”) (collectively referred to as “the Funds”).
