Appellant, joined by his wife, entered into a contract with appellee to build for the former a residence upon their homstead in accordance with certain plans for the agreed price of $8,651. The contract provided for a mechanic’s lien for the amount of the indebtedness so mentioned and was duly signed by both husband and wife and privily acknowledged by the latter. The specifications were not signed, but contained a provision that the owjier might make changes in the building during its construction.
