Appellee Jimmie Kitchens, a school teacher, filed suit in district court against the State Commissioner of Education (“the Commissioner”) and Tuloso-Midway Independent School District (“Tuloso-Midway”), appellants, for judicial review of the Commissioner’s denial of her appeal of Tuloso-Midway’s decision not to renew her teaching contract. See Term Contract Nonrenewal Act (“TCNA”), Tex.Edue.Code Ann. §§ 21.201-til (West 1987 & Supp.1994).
