COLEMAN, Justice.

This is an application for a writ of mandamus to require the Honorable William Blanton, Jr., District Judge, to grant a motion for non-suit filed by Petitioner in the capacity of next friend for a minor plaintiff.

Cause No. 868,973, pending in the 11th District Court of Harris County, Texas, is a suit for damages arising out of an automobile collision filed by petitioner individually and as next friend for his minor son.
