Plaintiff appealed from a judgment entered upon a jury verdict for the defendant. The Court of Appeals, by less than a unanimous decision, reversed the trial court (2 Wn. App. 548, 469 P.2d 950 (1970)). Defend*564ant then prosecuted this appeal under Rule II-2, Supreme Court Rules on Appeal.
Plaintiff’s complaint was pleaded in admiralty terms to recover damages for injuries suffered by him during the course of his employment aboard the defendant’s grain barge. Plaintiff alleged that the vessel was unseaworthy.
