Affirming in part and reversing in part.

This, appeal is an aftermath, of a case of the same style here on former appeal, the opinion in which forms the beginning point of the complicated matters now presented. Preston et al. v. Preston’s Adm’x, 245 Ky. 552, 53 S. W. (2d) 957. In that case M. L. Preston and wife, father and mother of Oscar Preston, who was the husband of appellant here, sought by appropriate action to require the widow to make settlement of his estate, claiming to be entitled to portions thereof.
