Appeal from an order of the General Term of the Supreme Court in the fifth judicial department, made January 18,1893, which reversed a judgment entered upon the report of a referee dismissing the complaint upon the merits, and which granted a new trial. This action was brought to compel the defendant to issue $12,500 of its capital stock to the plaintiffs, Susan B. Anthony and Mary S. Anthony, and to account for and pay over to the plaintiffs the dividends which had been declared thereon since the year 1883, together with other earnings properly distributable upon the plaintiffs’ stock.
