The appellee and plaintiff below, Kenneth Gibson Stem, filed this equity action in the Warren circuit court .•against the appellants and defendants below, James P. Flanigan and H. M. Bryant. He alleged in his petition that he was the owner of the right to operate for oil and *815gas on 82Vz acres of land in Warren county, which was owned in fee hy defendant, Bryant, from whom plaintiff obtained his leases and that Flanigan, with the consent and at the instance of Bryant, forcibly entered upon the land…
