(after stating the facts). The validity of the commitments here under examination depends . upon the power of the court which made them. The general power of the court to compel, by its process of contempt, witnesses to appear, to be sworn, and to testify in causes pending before it, is clear. The power has, however, a limitation imposed by the fifth amendment to the constitution, which provides “that no person shall be compelled in any criminal case to be a witness against himself.” The supreme court of the United States, in Counselman v.
