—In a proceeding pursuant to CPLR article 78 to compel respondent to credit certain jail time against a sentence imposed against petitioner, petitioner appeals from a judgment of the Supreme Court, Dutchess County (Delaney, J.) dated June 20,1983, which dismissed the petition.

Judgment reversed, on the law, without costs or disbursements, and petition granted to the extent indicated herein.
