ALEXANDER, Justice.
Hugh Glass brought this suit against the Texas & New Orleans Railroad Company to recover damages for the alleged negligent destruction of a barn and its contents by fire. It was alleged that one of the defendant’s engines was negligently; operated in such manner as to cause sparks to escape therefrom and set fire to said property.
