This suit was brought by the appellee, Samuel Schütz, against the Santa Be Street Railway Company,. the Santa Be Realty Company, and Z. T. White, upon the contract set out in our conclusions of fact, to recover the sum of $3,481.07, besides interest and attorney’s fees, from the Santa Be Street Railway Company as liquidated damages for the breach of said contract, and to foreclose, as against all the parties, a lien on certain property described in plaintiff’s petition, given by the contract to secure plaintiff in the payment of the money sued for.
