JOHNSON, District Judge.

This is an action by the trustee of a mortgage to recover the amount of taxes assessed upon the mortgaged premises during the period of ownership of the property by the First National Bank of Emporium, and paid out of the proceeds of a foreclosure sale.

*291The property in question was subject to a mortgage in the amount of $110,000. The property was purchased by the First National Bank of Emporium at a treasurer’s sale on October 12, 1931, and the deed therefor was delivered and recorded on December 22, 1931.
