Exceptions to report of special master, upon the petition of the Sabine Tram Company, praying for delivery of property.

The facts upon which the petition and report of the special master are based have been agreed upon between the parties, and are as follows: On January 19, 1903, a contract was entered into in Texas between petitioner and bankrupt for the sale and purchase of one Dickson Mogul locomotive, price $3,400, f. o. b. Hegewisch, *920Pease Car & Locomotive Works; terms, one-fourth cash, and balance evidenced by 24 notes for $113 each, falling due each month…
