Defendant, Richard Anthony Hernandez, appeals the judgment of conviction entered on a jury verdict finding him guilty of leaving the seene of an accident and the district court's habitual criminal judgments. At trial, the prosecutor asserted that defendant violated the statutory prohibition against leaving the seene of an accident solely because he failed to identify himself as the driver at the scene.
