The appellant was indicted and tried for the murder of John Palmer. He was convicted of manslaughter and sentenced to the state penitentiary for a term of twelve years, from which judgment he appeals.

Briefly stated, the facts are as follows: On November 6,1951, the deceased, John Palmer, and his wife, Charlotte *559Trask Palmer, daughter of appellant, made a visit to the home of the appellant. The deceased helped the appellant cut wood that afternoon, and later, he and Roosevelt Trask, the son of appellant, went to the Town of Wood-ville to take a load of cotton, returning about 9 o ’clock P. M.…
