BROADDUS, Presiding Judge.

This is a suit for specific performance of an alleged oral contract whereby the late Alfred L. Bealmear agreed to leave his son, Russell O. Bealmear, his entire estate at his death. Instead, he left a will disinheriting his son. The first Count of the petition, to contest that will, was dismissed. Trial of the issues on Count II in the Circuit Court resulted in a decree adverse to the son, from which he prosecutes this appeal.
