delivered the opinion of the court.. J. P. Ruth, the plaintiff in.error, sued Mary E. Devany, as county treasurer, and others, to. set aside a redemption from tax sale, and to cancel the redemption certificate. The judgment was for the defendants.

Certain mining property was owned by The Consolidated Seaton Mountain Mining Company. In 1900 the corporate existence of that company expired by lapse of time.
