Elrror to a judgment of the Corporation Court of the city of Fredericksburg in an action of assumpsit. Judgment for the plaintiff. Defendant assigns error.

The policy of insurance sued on by defendant in error as administratrix of her deceased son, Edgar E. De Vault, was issued by plaintiff in error December 15, 1906, loss, if any, payable to the estate of the insured; and the insured, Edgar E. DeVault, came to his death by drowning April 26, 1907.

After the death of the deceased, defendant in error furnished, upon blanks provided by plaintiff in error, proof of the death, and under date of June 3, 1907, received a letter from the secretary of the insurer informing her that the claim under the policy had been approved for payment, and check of…
