—In an action to recover damages for personal injuries and wrongful death based on medical malpractice, the defendant M.L. Hundert appeals, as limited by his brief, from so much of an order of the Supreme Court, Queens County (Graci, J.), dated September 14, 1992, as (1) denied his motion to dismiss the complaint, and (2) granted that branch of the plaintiff’s cross motion which was to direct him to appear for a deposition.
Ordered that the order is affirmed insofar as appealed from, with costs; and it is further,
