OPINION

SWEET, District Judge.

Plaintiffs Building Service 32B-J Health, Pension and Annuity Funds (the “Funds”) have moved for summary judg ment pursuant to Fed.R.Civ.P. 56. Defendant Vanderveer Estates Holding, LLC (“Vanderveer”) has cross-moved for summary judgment. For the reasons set forth below, summary judgment is granted in favor of the plaintiffs.

Local 32B-J, Service Employees International Union, AFL-CIO (“Union”) is a labor organization that represents members employed in the building service industry in metropolitan New York City.
