There are two motions — one by the judgment debtor to vacate a third-party order served on the Equitable Life Assurance Society of the United States and the other by the judgment creditor for the appointment of a receiver.
In support of the third-party order it appears that the judgment debtor was entitled, under an accident and health policy issued by the third party, to certain payments of disability benefits and that prior to the service of the third-party order he had been paid some of these benefits in installments by the third party and that at the time of the service the third party…
