Joseph M. Greenbaum, being the owner of certain real estate situated in Livingston county, conveyed the same by deed of trust to Jonathan Duff, as trustee, to secure a note of Greenbaum for the sum of $4,500 and interest, the date of the trust deed being January 1, 1874. Afterwards, Joseph H. Stitt became the purchaser of the real estate, subject to the trust deed. On Sept. 9, 1878, Duff, the trustee, sold'tlie land in question under the power in his trust deed, and out of the proceeds arising from such sale paid off the note which the trust deed was given to secure, and had remaining in liis…
