*1313Appeal from a judgment of the Monroe County Court (Richard A. Keenan, J.), rendered October 26, 2009. The judgment convicted defendant, upon his plea of guilty, of murder in the second degree and criminal possession of a weapon in the second degree (two counts).

It is hereby ordered that the judgment so appealed from is unanimously reversed, on the law, the plea is vacated, the motion to suppress defendant’s statements to the police is granted and the matter is remitted to Monroe County Court for further proceedings on the indictment in accordance with the following memorandum: Defendant…
