DAVIDSON, Presiding Judge.
This conviction was for assault to rape. The evidence shows that on the night of the alleged assault Miss Grace Sherwood and her companion, Miss Shadle, were occupying a room in a hotel at Weatherford, Texas; that they, in company with some companions, were attending a social gathering on the 4th of July; that their room was on the lower floor with a gallery partly surrounding it.
