This is an action of trespass on the case seeking damages for .personal injuries allegedly occasioned by the defendant’s negligence while the latter was an independent contractor and engaged in work in which the plain tiff was assisting as the employee of another. The case was tried to a superior court justice, sitting without a jury, and resulted in a decision for the plaintiff for $17,500 and costs. It is before us on the defendant’s bill of exceptions, but he presses only his exception to the decision. His other exceptions being neither briefed nor argued are deemed to be waived.
