The defendant, who had pleaded guilty to attempted assault in the third degree in violation of sections 110.00 and 120.00 of the Penal Law, now moves this court under the authority of CPL 220.60 (subd 3) to permit him to withdraw his guilty plea. He does not profess his innocence, nor does he deny the fact that, at the time of the entry of the plea, he freely and voluntarily admitted his guilt.
