Civil action, in the nature of a quo warranto, brought under C. S. 870, to determine the question of title to the office of sheriff of Polk County for the two-year period beginning in December, 1918, and ending in December, 1920.

The defendant and the relator were rival candidates for the office of sheriff of Polk County in the general election of 1918. The official returns, as received and declared by the canvassing board of said county, gave the defendant a majority of 2 votes; the result being 686 for the defendant and 684 for the relator.
