Plaintiff brings this action to recover damages sustained to an automobile for alleged negligence- of the defendant;- A trial was had in the lower court which resulted, in a verdict and - judgment in favor of the' plaintiff. On -this appeal defendant presents ten assignments of error. At the close of plaintiff’s case defendant'made-a motion to dismiss the action, which motion' was denied y thereupon defendant moved for a directed verdict in favor of the- defendant for dismissal of the case, which was also denied.
