This matter is on to be considered upon the motion of the defendants, appellees herein, to dismiss the appeal for the reason that the order appealed from is not a final order.
The record shows that on November 2, 1959, the trial court sustained a demurrer to the petition of the plaintiff on the grounds that the action was not brought within the statutory-period and that the petition did not state a cause of action.
