MEMORANDUM OPINION

MENTZ, District Judge.

The petitioners in this case are citizens of Cuba who arrived in the United States during the 1980 Mariel boatlift (the Freedom Flotilla). They are being detained under the civil immigration detention powers conferred on the Attorney General by the Immigration and Nationality Act (the Act), 8 U.S.C. sections 1101-1524.
