Plaintiff brought action to recover damages for injuries received in an automobile collision at the intersection of Burnside street and Union avenue, in Portland, Oregon. A verdict of $10,000 was returned in his favor and judgment entered thereon. The defendant moved to set aside the judgment and verdict and for a new trial setting up all the statutory grounds.
