In a bill to foreclose a mortgage on the steamship Kanawha, filed by the Mercantile Trust and Deposit Company, against the ship’s owner, the Mary Lee Coal and Railway Company, in the city court of *358Birmingham., receivers of the ship were appointed, and they, accordingly, took her into their custody, as such receivers.

Pending said foreclosure bill, to-wit, on January 26, 1895, the present complainant, the City National Bank of Birmingham, claiming a lien by contract on the ship, prior in right to the mortgage lien, filed the present bill, in the same court, to enforce it, praying that the…
