This is an action brought in the court below by Wm. 0. Godfrey, as administrator of the estate of Wm. H. Godfrey, deceased, against David Wingert, upon a contract of indorsement by the latter upon a promissory note. The note was dated at Dixon, March 13, 1871; was due in nine months thereafter, with interest at ten per cent per annum, if not paid when due; was for the principal sum of $140; was payable to the order of David Wingert at the Lee County Rational Bank; was signed by Alexander P. Hittle and Robert Laughlin; was indorsed in blank by Wingert; was afterward indorsed by B. B. Higgins;…
